Terms and Conditions

1. Introduction

Welcome to Flora Bella ("Flora Bella Rentals," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our website, the rental services we provide to you, and your obligations to us. By accessing or using our website or services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

2. Services

We provide floral arch rentals and related services. The specific details of our services, including pricing and availability, are described on our website. We reserve the right to modify or discontinue any service at any time without notice.

3. Reservations and Payments

• Payment Methods: We accept all major credit cards, Apple Pay, Google Pay, and PayPal.
• Cancellation Policy: Cancellations must be made in writing via email to amy@florabellarentals.com. If the cancellation is made at least 90 days prior to your event, we reserve the right to retain 50% of your total original rental charge as a non-refundable fee. Any additional expenses incurred by us may be deducted from your refund; these expenses may include, but are not limited to, any florals ordered for customization, time spent in consultation, design of your pieces, and fees associated with the refund. If a cancellation is made within 90 days of your event, we reserve the right to retain 100% of your original rental charge.
• Changes to Orders: Depending on availability, additions may be made up to 7 days prior to your event date.
• Natural Disaster: In the event of war, fire, tragedy, pandemic, natural disaster, or other similar emergency within 90 days of your event, we will credit your original payment to a rental on the next available day of your choice.

4. Delivery and Setup

• Delivery Area: We offer free delivery within 30 driving miles of our warehouse at 711 Signal Mountain Road, Chattanooga, TN 37415. Delivery beyond 30 driving miles is subject to approval and additional fees.
• Setup and Removal: Our team will handle the setup and removal of all rental items. Your original rental charge includes one setup and removal at a single location. Moving items to a second location will incur additional fees. Items may only be moved by our staff unless otherwise expressly noted.
• Pickup Fees After 9:00 PM:
  • 9:30 PM: $50
  • 10:00 PM: $100
  • 10:30 PM: $150
  • 11:00 PM: $200
  • 11:30 PM: $250
  • 12:00 AM: $300
  • Pickups after 12 AM are not available.

5. Use of Rental Items

• Care and Responsibility: You are responsible for the care and safekeeping of all rental items from the time of delivery until they are picked up by our team.
• Damage or Loss: Any damage to rental items will be charged to you at replacement and downtime cost, all at our discretion.

6. Inclement Weather

No rental item can be in the rain as rain will ruin the permanent botanicals. A tarp will be provided if there is a chance of rain. We will not set up items outdoors in the rain, and we reserve the right to pick up rental items early if inclement weather is predicted. Please know that some items may be moved by the venue coordinator with prior written approval.

7. Substitutions

We reserve the right to make substitutions in the event the flowers or décor received are not of the quality suitable to your event. The integrity of the proposed look and color scheme will be maintained, and flowers of equivalent monetary value will be used.

8. Liability

We are not responsible for any injuries, damages, or losses that occur during the use of our rental items. By using our services, you agree to (1) assume liability for any injuries, damages, or losses that occur during the use of our rental items, and to (2) indemnify and hold us harmless from any claims or liabilities arising from your use of our rental items.

9. Privacy Policy

Your use of our website and services is also governed by our Privacy Policy. Please review our Privacy Policy for information on how we collect, use, and protect your personal information.

10. Modifications to Terms

We reserve the right to modify these Terms at any time without notice. Any changes will be effective immediately upon posting of the revised Terms on our website. Your continued use of our services or website following the posting of changes constitutes your acceptance of such changes.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, including the Option Rules for Emergency Measures of Protection. The arbitration hearing shall take place in Chattanooga, Tennessee, before a single arbitrator. Judgement on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

12. Location Limitations

We are limited by the rules and guidelines of your venue and its management. To avoid disputes, it is your responsibility to communicate with your venue and confirm that our rentals will be accepted by the venue and fit in the desired space. Negotiation with the venue and its management for moderation of rules and guidelines is your responsibility. We will offer technical recommendations only. Reimbursements will not be made for unused items due to venue or location limitations.

13. Termination of Contract

We reserve the right to cancel this contract if at any time we feel that the obligations cannot be met. We will, at our discretion, credit the amount paid minus any actual costs incurred.

14. Disclaimer

By renting our products, you understand that though some of these flowers look real and are named after real flowers, some of them are in fact artificial and therefore only resemble the real flowers after which they are named.
